Alec Baldwin

New Mexico’s State district attorney may be filing criminal charges against Hollywood star Alec Baldwin and four other people who worked on the Rust film set following last October’s shooting.

Santa Fe DA Mary Carmack-Altwies stated in a letter to the NM finance board that her office has begun to consider charges, as reported by the Santa Few New Mexican, of them being homicide and gun violations charges.

“One of the possible defendants is well-known movie actor Alec Baldwin,” the District Attorney stated in the letter back at the end of August. However, aside from Baldwin, she did not identify any other individuals who might be charged.

“If charges are warranted, the [First Judicial District Attorney] anticipates prosecuting up to four individuals. My expenses for the “Rust’ [case] will begin immediately and will be costly.”

The request for funding, according to the DA, cannot wait until the next legislative session as “the evidence has just been returned, the state is ready to make charging decisions in the ‘Rust’ case,” she stated in the letter.

Carmack-Altwies has requested $635,500 for what might potentially be four separate jury trials as well as to hire an investigator, media spokesperson, and other experts. As things stand the state has given the DA’s office about $317,000 to pay for a special prosecutor to oversee the case, the prosecutor being Andrea Reeb.

Baldwin’s phone was also handed over to prosecutors.

Last month major pieces of evidence were found in the case that supported the theory that Baldwin did, in fact, pull the trigger on set, unlike his original claims. The FBI came to the result that the gun could only fire by a pull of the trigger. It is still unknown how live rounds actually ended up in his possession,

Baldwin’s attorney denies the conclusions however, saying that their reports were “misconstrued.”

“The gun fired in testing only one time — without having to pull the trigger — when the hammer was pulled back and the gun broke in two different places,” said Baldwin’s attorney Luke Nikas. “The FBI was unable to fire the gun in any prior test, even when pulling the trigger, because it was in such poor condition.”
