A federal appeals court has allowed for Juul to continue selling its products in stores following a ban by the FDA on the e-cigarette products.
Earlier Friday, Juul filed an emergency motion, seeking a temporary hold while appealing the sales ban. They claimed that the FDA ban is “extraordinary and unlawful,” and that the FDA ban would require Juul to immediately halt its business.
The FDA’s ban is a part of a sweeping move to try and regulate the e-cigarette business. Anti-vaping campaigns have focused on Juul heavily over the past few years, as Juul was popular amongst youth smokers. Juul has already ben regulated previously, having all fruit-flavored vape pods banned.
In order to continue selling in the United States, the FDA is requiring companies to show the benefits of their e-cigarettes to public health. Essentially, companies need to prove that their products actually help adult smokers quit their smoking habits and that their products do not get young people addicted instead.

The FDA stated that the application submitted by Juul did not include enough information to evaluate potential health risks. Juul countered, saying it submitted enough information and data to address the issues.
A panel of three judges in the US circuit court of appeals allowed for Juul to continue selling its products while the court reviews the case.
Juul has fallen in popularity with teenagers in recent years, but continues to hold a significant portion of the e-cigarette market. Juul’s devices claim to bypass most of the toxic chemicals produced by burning tobacco by heating a nicotine solution into a vapor that’s inhaled.
Juul stated that it submitted an application of 125,000 pages to the FDA two years ago, including studies that evaluate the health risks of using Juul’s products.
The FDA has allowed other companies to continue selling and has banned other companies as well.
